Terms and Conditions of Use

You agree to the terms and conditions outlined in this Terms and Conditions of Use Agreement with respect to our Site. The Site is owned and operated by White Falcon Publishing Solutions LLP. These Terms govern access to and use of the Site (including browsing, accounts, the bookstore, and related platforms).

If you have a signed publishing agreement or other written contract with White Falcon Publishing Solutions LLP, that signed agreement governs the publishing, printing, distribution, royalty and related services described in it. Where that signed agreement and these Terms differ on the same subject, the signed agreement prevails for those services. These Terms still apply to your use of the Site.

Subject to that, these Terms are the agreement between us and you for use of the Site. We may update these Terms by posting the current version on the Site. Updates to these Terms do not change a signed publishing agreement. You should review these Terms before using the Site.

The content, organization, graphics, design, and other matters related to the Site (as distinct from literary works you submit for publication) are protected under applicable copyrights and other proprietary laws, including but not limited to intellectual property laws. The copying, reproduction, use, modification or publication by you of any such Site matters or any part of the Site is strictly prohibited, without our express prior written permission.

Copyright in your book and other literary works remains with you, as described in the Content section and, where you have one, in your signed publishing agreement. White Falcon Publishing receives only the limited licence needed to print, promote, distribute and sell the work.

We reserve the right in our sole discretion, without any obligation and without any notice requirement to you, to edit or delete any documents, information or other content appearing on the Site, including these Terms. That right does not allow us to make material changes to your book under a signed publishing agreement without your approval of the print-ready files, except for minor technical modifications needed for production.

As a condition to use the Platform on the Site, the User is required to create an account with us. You must be at least 18 years of age to register, or you must have the verifiable consent of a parent or lawful guardian as required by the DPDP Act. White Falcon Publishing reserves the right to refuse registration of, or cancel a User in its discretion, including where we believe the account is used by a child without such consent.

The personal data you provide at registration is processed for the specified purpose of creating and administering your account, as described in the Privacy Policy.

You agree to indemnify, defend and hold us, our officers, our partners, attorneys and employees harmless from any and all liability, loss, damages, claim and expense, including reasonable attorney’s fees, related to your violation of these Terms or use of the Site, and related to the content you submit for publication (including claims of libel, defamation, inaccuracy, omission, infringement or violation of privacy or publicity), except to the extent a signed publishing agreement provides otherwise.

Nothing in these Terms reduces any indemnity, liability cap, or other protection given to you in a signed publishing agreement, and nothing in these Terms makes White Falcon Publishing responsible for the authenticity, accuracy, or completeness of your content.

THE SITE AND THE INFORMATION ON IT ARE PROVIDED “AS-IS” AND “AS AVAILABLE.” ALL WARRANTIES, EXPRESS OR IMPLIED, ARE DISCLAIMED WITH RESPECT TO THIS SITE AND ANY WEBSITE WITH WHICH IT IS LINKED, INCLUDING ANY IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, QUALITY AND FITNESS FOR A PARTICULAR PURPOSE. THE SITE MAY CONTAIN BUGS, ERRORS, PROBLEMS OR OTHER LIMITATIONS. IN PARTICULAR, BUT NOT AS A LIMITATION, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING DAMAGES FOR LOSS OF BUSINESS, LOSS OF PROFITS, LOSS OF MONEY, LITIGATION, OR THE LIKE), WHETHER BASED ON BREACH OF CONTRACT, BREACH OF WARRANTY, NEGLIGENCE, PRODUCT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM US THROUGH THE SITE SHALL CREATE ANY WARRANTY, REPRESENTATION OR GUARANTEE NOT EXPRESSLY STATED IN THESE TERMS. THE INFORMATION AND ALL OTHER MATERIALS ON THE SITE ARE PROVIDED FOR GENERAL INFORMATION PURPOSES ONLY AND DO NOT CONSTITUTE PROFESSIONAL ADVICE.

White Falcon Publishing is not liable for errors, omissions, inaccuracies or lack of authenticity in content supplied by an author, including after language review. If you have a signed publishing agreement, liability for the publishing services described in it is as set out in that agreement (including any cap on fees paid), and not by the broader disclaimers that apply only to use of the Site.

All responsibility or liability for any damages caused by viruses contained within the electronic file containing the form or document is disclaimed. We will not be liable to you for any incidental, special or consequential damages of any kind that may result from use of or inability to use the site.

All rules, terms and conditions, other policies (including privacy policies) and operating procedures of third-party linked websites will apply to you while on such websites. We are not responsible for the content, accuracy or opinions expressed in such websites, and such websites are not investigated, monitored or checked for accuracy or completeness by us. Inclusion of any linked website on our Site does not imply approval or endorsement of the linked website by us. This Site and the third-party linked websites are independent entities and neither party has authority to make any representations or commitments on behalf of the other. If you decide to leave our Site and access these third-party linked sites, you do so at your own risk.

We may advertise third-party linked websites from which you may purchase or otherwise obtain certain goods or services. You understand that we do not operate or control the products or services offered by third-party linked websites. Third-party linked websites are responsible for all aspects of order processing, fulfillment, billing and customer service. We are not a party to the transactions entered into between you and third-party linked websites. You agree that use of such third-party linked websites is at your sole risk and is without warranties of any kind by us, expressed, implied or otherwise. Under no circumstances are we liable for any damages arising from the transactions between you and third-party linked websites or for any information appearing on third-party linked websites or any other site linked to or from our site.

The materials appearing on this site could include technical, typographical, or photographic errors. White Falcon Publishing does not warrant that any of the materials on its website are accurate, complete, or current. White Falcon Publishing may make changes to the materials contained on its website at any time without notice. White Falcon Publishing does not, however, make any commitment to update the materials.

White Falcon Publishing may revise these Terms for the Site by posting the current version here. By using the Site you agree to be bound by the version then posted. A posted revision of these Terms does not amend a signed publishing agreement.

You keep the copyright in Content you submit for publication. White Falcon Publishing does not acquire ownership of your work. You grant White Falcon Publishing a non-exclusive licence to print, post, display, copy, promote, distribute and sell that Content within the limitations you set during the publishing process or in a signed publishing agreement. All rights not expressly granted remain with you.

If you include any information that could be used to identify you, such as your personal phone number, e-mail address or a government-issued ID number, (collectively “Personal Data”) in your Content, it will be included with your Content when published or sold. By including Personal Data in the Content you post, you authorize White Falcon Publishing to disclose that Personal Data as part of the Content. You may not include Personal Data about other people in your Content unless you have a lawful basis to do so.

White Falcon Publishing may excerpt your Content, excluding Personal Data, for use in marketing and promotion of the work, and may make minor modifications for technical or production reasons. Material changes to a book under a signed publishing agreement are made only with your approval of the relevant files. White Falcon Publishing will credit you and/or the original artist.

By uploading Content to the Site you represent and warrant, at all times during the term of this Agreement, that the Content:

• Is owned by you or, to the extent owned by someone else, that you have permission to provide the Content to White Falcon Publishing for use as described above and, in either case, that the Content does not contain any Personal Data about any individual other than you;
• Does not violate any copyright, trademark, trade secret or other intellectual property right of any third party;
• Does not invade any individual’s right of privacy or publicity;
• Does not contain material that is unlawful, obscene, defamatory, pornographic, indecent, lewd, harassing, threatening, harmful, invasive of privacy or publicity rights, abusive, inflammatory, or otherwise objectionable;
• Does not include malicious code, which includes, without limitation, viruses, Trojan horses, worms, time bombs, cancelbots, or any other computer programming routines that may damage, interfere with, surreptitiously intercept, or expropriate any system, program, data, or personal information (including Personal Data);
• Does not break the law, facilitate the breaking of the law, or violate any applicable regulation or White Falcon Publishing rule or policy;
• Does not offer or disseminate fraudulent goods, services, schemes, or promotions, or promote domain names, URLs, or hyperlinks that constitute commercial content such as that found in advertising, promotions, or solicitations;
• To the best of your knowledge, all factual information in the Content you upload is true and accurate, and the use of any recipe, formula, or instruction in the Content will not result in personal injury to any person. Despite all this, White Falcon Publishing cannot guarantee the accuracy, integrity or quality of Content.

White Falcon Publishing reserves the right to refuse to permit your publication on the Site of any Content that White Falcon Publishing, in its sole discretion, deems in violation of the terms and conditions set forth above.

In addition, you represent and warrant that you have the legal capacity to enter into this Agreement, and that the entering into of this Agreement does not conflict with any arrangements or agreements between you and any other person or entity.

Authors remain solely responsible for the authenticity, accuracy, originality, completeness and legality of the content they submit for publication. Views expressed in a book are the author’s views. White Falcon Publishing does not endorse those views and is not responsible for them.

White Falcon Publishing does review books before they are published, primarily from a language perspective (for example grammar, usage, sentence formation and readability), where language review or editing is part of the publishing arrangement. That review is not fact-checking, legal clearance, verification of authenticity, or a guarantee that the work is error-free. Remaining spelling, grammar or other language issues after review remain the author’s responsibility.

White Falcon Publishing is not liable for errors, omissions, inaccuracies or lack of authenticity in the content, including after language review. The author agrees to take responsibility for the content, as also set out in the publishing agreement where one is signed. Users can be held legally liable for the contents of their books if those books include, for example, defamatory comments or material protected by copyright, trademark, patent or trade secret law without the permission of the author or owner.

The user agrees to indemnify and hold harmless White Falcon Publishing, its employees, directors, officers, agents and their successors and assigns from and against any and all liabilities, damages, losses, costs and expenses, including attorney’s fees, caused by or arising from or in connection with the contents of the author’s book, including any claim of libel, defamation, inaccuracy, omission, violation of rights of privacy or publicity, loss of service by other members and infringement of intellectual property or other rights.

As White Falcon Publishing asks others to respect its intellectual property rights, it respects the intellectual property rights of others. If you believe that material located on or linked to by the Site violates your copyright, you are encouraged to notify White Falcon Publishing in accordance with White Falcon Publishing’s Digital Millennium Copyright Act (“DMCA”) Policy. White Falcon Publishing will respond to all such notices, including as required or appropriate by removing the infringing material or disabling all links to the infringing material. This Agreement does not transfer from White Falcon Publishing to you any White Falcon Publishing or third party intellectual property, and all right, title and interest in and to such property will remain (as between the parties) solely with White Falcon Publishing.

For services ordered only through the Site and not covered by a signed publishing agreement, we allow cancellation if the service has not been commenced, for a full refund minus payment processing fees, if applicable.

If you have a signed publishing agreement, cancellation, refunds and termination follow that agreement: services not yet delivered as at termination may be refunded; charges for services already rendered are not repaid. After publication, inventory and delisting are handled as that agreement provides.

Products ordered through the website for delivery within India are shipped through our courier partner if the delivery service to the destination is available. In absence of courier service to the desired location, the products are shipped through Indian Postal Service.

Shipping to locations outside India is done through Indian Postal Service. International Book Post shipping requires us to ship books in open envelope and is not registered. Therefore, we will not be in a position to provide a tracking number.

The shipping times mentioned anywhere on the website are approximate and we cannot guarantee them. Customers are recommended to place an order early on if they have a deadline to meet. Apart from the shipping time, print-on-demand books ordered through the Site typically need 4 to 7 business days for production. Print runs, reprints and delivery under a signed publishing agreement follow the timelines in that agreement, which may be longer (including time with third-party printers and couriers).

Books purchased through the Site as a customer (bookstore or similar orders) are typically printed as they are ordered. Because those copies are printed on demand, White Falcon Publishing cannot cancel those orders, accept returns or provide refunds on them, except for a production defect as described below. Some titles may instead be supplied from a short print run held in stock; that does not change the no-return rule for ordinary customer purchases.

White Falcon Publishing is not liable for the authenticity, accuracy or completeness of a book’s content, or for remaining language or design preferences after the author has approved the files. Authors remain responsible for their content. Language review before publication, where provided, does not make White Falcon Publishing liable for errors or omissions in that content.

If you receive a product with a production defect (missing pages, torn corners, etc.), we will provide a replacement copy. Please send an e-mail to contact@whitefalconpublishing.com mentioning your order number and the defect you found.

Refunds and termination for a publishing project you commissioned are not governed by this shop-purchase rule. They follow section 15 and, where you have one, your signed publishing agreement.

Neither White Falcon Publishing (including its and their directors, employees, affiliates, agents, representatives or subcontractors) shall be liable for any loss or liability resulting, directly or indirectly, from delays or interruptions due to electronic or mechanical equipment failures, telephone interconnect problems, defects, weather, strikes, walkouts, fire, acts of God, riots, armed conflicts, acts of war, delays by third-party printers, couriers or sales platforms, or other like causes. White Falcon Publishing shall have no responsibility to provide you access to the Site while interruption of the Site is due to any such cause. If you have a signed publishing agreement, the force-majeure and third-party-dependency clauses of that agreement also apply to the services described in it.

These Terms are exclusively based on and subject to Indian law, including the Digital Personal Data Protection Act, 2023. For disputes arising out of or relating to use of the Site, you consent to the exclusive jurisdiction and venue of courts in Chandigarh, India. Use of this website is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including without limitation this paragraph.

If you have a signed publishing agreement, disputes about the services in that agreement are resolved as that agreement provides (including good-faith negotiation and, where it so states, arbitration in Chandigarh under the Arbitration and Conciliation Act, 1996), and the courts in Chandigarh have exclusive jurisdiction over any remaining legal proceedings. Nothing in this clause limits your right to approach the Data Protection Board of India in respect of a personal-data grievance after you have used the Grievance Officer process described in the Privacy Policy.

White Falcon Publishing Solutions LLP is the Data Fiduciary for personal data processed through the Site. We process personal data in accordance with the Digital Personal Data Protection Act, 2023, the Digital Personal Data Protection Rules, 2025, and our Privacy Policy.

Using the Site is not consent for every use of your personal data. Processing that is necessary to provide a service you have asked for (including registration, orders, publishing services and author payouts) is carried out for that specified purpose. Marketing communications and non-essential cookies require a separate consent, which you may withdraw at any time as described in the Privacy Policy and the cookie consent banner.

You must provide accurate personal data when you register, place an order, or request a payout, and you must keep it current. You may ask us to correct account, order, shipping or payout data as described in the Privacy Policy. Nothing in these Terms makes White Falcon Publishing responsible for the authenticity, accuracy or completeness of content you submit for publication.

We may share personal data with processors and sales platforms as described in the Privacy Policy, including AWS (Mumbai) for hosting, Shopify for the WFP Book Store, Razorpay and PayPal for payments and international royalty payouts, Google for analytics and advertising cookies you accept, Cloudflare for form bot-protection, WhatsApp for sales and support chats you send us, Amazon (including KDP), Ingram and Flipkart for print, listing, fulfilment and book sales, and India Post, Blue Dart, DTDC, Professional Couriers and other courier partners for delivery. We do not use solely automated processing to make a decision that has a legal or similarly significant effect on you. Non-essential cookies, including advertising cookies, run only if you accept them.

You agree not to upload personal data about any individual other than yourself unless you have a lawful basis to do so. You are responsible for personal data you include in manuscripts and other content, as further described in the Content section and in the Privacy Policy. Unpublished files are processed to provide the publishing service and are not treated as public; once you approve publication, personal data left in the work may be widely available.

You may access, correct or request erasure of your personal data, withdraw consent, nominate a person to exercise your rights, and raise a grievance, by writing to our Grievance Officer at grievance@whitefalconpublishing.com. The Grievance Officer is Hardeep Singh. Full contact details and timelines are in the Privacy Policy.

The Site is directed at adults. By using the Site you represent that you have completed 18 years of age, or that a parent or lawful guardian is contracting on your behalf and has given verifiable consent to any processing of a child’s personal data as required by the DPDP Act.

We do not knowingly process personal data of a child (a person under 18 years) without that verifiable parental or guardian consent, and we do not track or target advertising at children. If we learn that an account belongs to a child without such consent, we may suspend or cancel the account and erase the personal data, subject to any legal retention duty.

We will respond within a reasonable period that will not exceed 90 days of receipt. If you are not satisfied, you may complain to the Data Protection Board of India in the manner prescribed under the DPDP Act.
